In an op-ed on Wednesday, FCC Chairman Tom Wheeler announced he is proposing to regulate the Internet as a public utility. Wheeler wants to use Title II of the Communications Act to make it illegal for the speeding up or slowing down of Web traffic, as well as the blocking of traffic. "My proposal assures the rights of Internet users to go where they want, when they want," Wheeler wrote, "and the rights of innovators to introduce new products without asking anyone's permission." The new rules will be brought up for a vote on February 26.

The office of the Arizona Attorney General is asking for a dismissal of a lawsuit filed by the teacher who was viciously assaulted and raped when left alone and unguarded in a prison classroom with a convicted sex offender. The argument by the AG is basically that it's the teacher's fault as she should have been aware of the risk. "Plaintiff is an ADOC (Arizona Department of Corrections) employee who routinely worked at the prison complex," Assistant Attorney General Jonathan Weisbard wrote in his motion to dismiss. "By being placed in a classroom at the complex, the officers were not placing Plaintiff in any type of situation that she would not normally face. The risk of harm, including assault, always existed at a prison like Eyman."
