In front of a Senate panel on Tuesday, Obama's nominee for FBI director, James B. Comey, said that while he was deputy attorney general under Dubya—and while he said it was OK to waterboard—he believed the tactic was torture. Now Comey thinks waterboarding is illegal, too. Comey said that at the time, it was difficult to label the technique illegal because the law itself was vague. That being said, he says he told the administration to stop waterboarding. While Comey is a pick who has actually received some bipartisan support, some Democrats are concerned with his time serving in the Bush administration.

On the Run

Is Edward Snowden's time in the airport transit lounge nearing an end? A senior Russian lawmaker tweeted that Edward Snowden has accepted Venezuela's offer of asylum, but then deleted the tweet. Venezuelan President Nicolas Maduro has been publicly welcoming the former NSA contractor for several days, saying that he can come to Venezuela to live without "persecution from the empire." Nicaragua and Bolivia have also offered Snowden asylum. Bolivia's President Evo Morales made his offer three days after his plane was rerouted under suspicion that he was sneaking Snowden out of Moscow.

SOUTH OF THE BORDER

We're no longer No. 1? Mexico has overtaken the U.S. in terms of obesity rate, according to a United Nations report released Tuesday. Nearly 33 percent of Mexicans are now obese, according to the report, and 70 percent are overweight. The report says the young and the poor are disproportionately affected—although as the country's income has grown, so has its waistlines. In addition to a more urban economy, the country's restaurant culture promotes foods that are fried and high in calories. But buck up, Americans who are sad that we've dropped out of top slot: the U.S. obesity rate is nearly 32 percent, not far behind.

Eliot Spitzer sweated through his shirt, was heckled about his black socks, and was prevented from meeting with voters, but the former governor seemed pleased with his first campaign appearance for city comptroller. David Freedlander reports.
