Two-and-a-half hours before the scheduled execution of Missouri death-row inmate Herbert Smulls, the U.S. Supreme Court issued a temporary stay. The court will rule Wednesday on the fate of the 56-year-old, who was convicted of killing a St. Louis County jeweler in 1991. His lawyer is arguing that the state's failure to disclose the compounding pharmacy that the execution drug was purchased from leaves it unable to know whether the formula could cause pain and suffering. The Supreme Court is expected to rule later Wednesday.

OPENING UP

Former Miami Dolphins NFL tackle Jonathan Martin made news in 2013 for alleging constant harassment by teammates, singling out guard Richie Incognito. Now, in his first interview since that firestorm, Martin says the bullying left him feeling "trapped like I didn't have a way to make it right. And it came down to the point where, you know, I thought it was best just to remove myself from the situation." Martin said the bullying was more than the usual locker room hazing, especially on the part of Incognito.

TOUGH GUY

Touchy, touchy. Republican Congressman Michael Grimm of New York's Staten Island threatened a NY1 reporter on Tuesday night after being asked about campaign-finance investigations after the State of the Union address. "You're not a man. I could break you in half," stormed the representative. Grimm has been linked to an allegedly corrupt Israeli rabbi, and his ex-girlfriend has been indicted on charges of being a straw donor. When initially asked the question, Grimm responded, "I'm not speaking about anything that is off-topic. This is only about the president's speech," but then couldn't help himself and continued, saying, "Let me be clear to you, you ever do that to me again I'll throw you off this f——-g balcony."
